If your privat server dont hold any blizzard content than not. Running one with blizzard content is against law in germany. There are Copyrights also for DBs and you hold a db with a copy of the wow story, quests etc. Its the same as copy illegal movies or music.

Blizzard earn mony by providing the servers. You pay once for the client and then monthly for the servers and updates. If you setup a privat server and use a blizzard like db you use stolen content.
The server is a freeware project but why do you think is there no blizzard db on the server hps?

Not the LAW. Only Blizzards EULA.
LAW problems are only if you share existing stuff from Blizzard like DBs or modified content files like an reskinned model.
